Although the Board of Supervisors has not met to discuss how to deal with the new law, McCarthy thinks that changes will probably include tightening up the subdivision ordinances.

“Applicants will have to toe the line, so that some of the protection we need will still be there,” he said.

Other changes that have been suggested include changing the density allowed “by right” from 25 acres to 50 acres, but McCarthy doesn’t think that’s likely.

The effect of losing the special exception process in Fauquier is only now being measured.

According to a report made public Tuesday, there are 8700 potential new homes currently requiring special exceptions that could be built without going through the process after January 1.
