such regulations? DEQ rules state protection is intended to go beyond the normal protection from pollution contaminants provided by DEQ. This will definitely subject landowners to more onerous rules and may well end up with property that must be abandoned. In this regard, I want to reiterate that no one can assure us that nonpoint sources will not be covered in the future.
In addition, Rappahannock needs control of land use, if the Hazel and other rivers are designated as Tier III waterways, the county will not control land use, the Federal and * State government will.
Finally I have to ask, how can anyone say absolutely the permanent designaion will not affect landowners when we will be subject to onerous and unknown Federal and State regulations? Have those involved in the nomination process discussed this with the landowners adjacent to the river in Rappahannock county? Do you know the terrain? Do you know what future regulations EPA and DEQ could impose on us?
As a land owner living adjacent to the river, therefore, I urge the Board of Supervisors to reject the proposal to forward the Hazel River for consideration by the State Water Control Board as a Tier III Exceptional Water as it is unnecessary, burdensome and would create intrusive State and Federal regulation.
