Environmental Protection Agency (EPA), further federal regulations could negatively affect the river and landowners without input from the landowners adjacent to the river, the Rappahannock County Board of Supervisors and other citizens of Rappahannock. For example: the definition of pollutant is very broad. Currently nonpoint sources are supposedly exempt. Suppose the rules are changed by EPA in the future to broaden the definition of pollutant and to include nonpoint source? The designation of the Hazel would be a permanent one and we cannot foresee future EPA regulation as a result, Federal action could effectively condemn our property as the government did in the 30s.
I have asked the Board of Supervisors to consider and respond to the following questions before proceeding:
1. What is the current condition of the Hazel River? Is there evidence of deteriorating water quality? Is it impaired in some way?
