S. senators shall be chosen from among the various state legislatures.” Members of the Virginia General Assembly that met in the fall of 1788 to select Virginia’s first two “Senators” understood that they were not required to select those “Senators” from among the members of the General Assembly. One of the men they selected, Richard Henry Lee, was not a member of the General Assembly at that time.
