The supervisors struggled to craft a noise restriction that would be objective and not make the Scrutons vulnerable to a single neighbor who has a problem with them or the conference center.
Hampton District Supervisor Bryant Lee said it would be virtually impossible to prevent any sound from being heard at the property line. A single violin or a car radio could be heard on Hawlin Road behind Montpelier, he said.
“I really believe it’s going to be difficult for the county to enforce this,” Piedmont District Supervisor Eddie Wayland said.
Establishing a specific limit on decibel level would also be a problem, because the county does not have the manpower to commit a person to measuring the noise there.
Commonwealth’s Attorney Peter Luke solved the problem by suggesting that a violation of the noise limit require objections from at least two adjacent landowners. The supervisors accepted that solution.
