BZA member Hal Forward read a resolution calling for a defense to the ski area suit. Noting that Rappahannock Commonwealth Attorney George Davis had advised the BZA that he would not represent them, Forward stated that the BZA was unanimous in its opinion that the denial of the ski area’s special use permit “protected the rights and best interests of the citizens of Rappahannock” and therefore ought to be defended.

Defense against the ski area suit, he continued, was also “absolutely essential to the integrity of the Rappahannock Zoning Ordinance.”
