Previous witnesses for the plaintiffs had spoken repeatedly of finding the colonel in similar, “inappropriate” apparel while the plaintiff's medical experts tied this change in dressing habits to mental deterioration.
But Melton testified that the colonel admitted to him and his wife that he had trouble controlling both his bladder and bowels. “He said he was sitting as close to the bathroom as he could with as little on as possible because he didn’t want to foul himself.” Melton added that Holmes gave this same explanation when visitors found him in pajamas.
‘‘It wasn't within my capacity or ability to take advantage of him,” said Washington real estate agent Newbill Miller, telling the jury of his land transactions with Holmes. He said he dealt with Holmes for the last time in April, 1979, six months before the contested will was executed, and saw him later when the colonel spoke on a zoning issue at a public hearing of the county Planning Commission. “He was very much in command of the situation and very factual and to the point,” Miller said.
