pahannock News requested a copy of an architectural program and budget cost analysis prepared by the Richmond firm of MoselyHenning in connection with construction of a new combination vehicle maintenance and school board office building. The board contracted for the work at a price of $2,500 and the report was presented and discussed at some length in open session and later in an executive meeting.
The request for a copy of the report was denied. The News asked for the denial in writing and was told that conformation would come from the school board's Harrisonburg attornev. Phillip Stone. The grounds cited by Stone in a letter dated August 16 and signed by the superintendent of schools specified that the architectural report was exempt from FOI requirements because it (1) qualified as working papers of a chief executive officer of a political subdivision and (2) related to condition, acquisition or use of real property and investing of public funds where competition or bargaining is involved.
