Amissville resident Olga Fontaine that the school board had violated the Freedom of Information (FOI) Act by refusing to release certain documents.
In the August 23 letter to Estabrook, Baumgardner, as Commonwealth's attorney, asked for copies of the information sought by the News and Fontaine. “I shall, upon receipt of such information, deliver same to the Rappahannock News and Ms. Fontaine,” he informed the superintendent.
Baumgardner also pointed out to Estabrook and the school board that the Virginia Code specifies that FOI regulations are to be "liberally construed to promote an increased awareness by all persons of government activities and afford every opportunity to citizens to witness the operations of government.” Adding emphasis with underlines, the commonwealth's attorney quoted from the Code that "Any exception from applicability shall be narrowly construed in order that no thing which should be made public may be hidden from any person."
