“I’m sure there aren't too many people here who haven’t heard these same rumors,” said commonwealth’s attorney candidate David Konick when faced with a question at Wednesday’s forum on his action in the hours following the shooting death of a Flint Hill farm manager, last November.
Ranee Spellman, manager of Patricia Saltonstall’s Points of View Farm, was shot from his bulldozer as he was working on a right-of-way that served three lots belonging to Saltonstall and a lot owned by Diane and Roger Kidwell. Diane Kidwell's trial on second degree murder charges ended in a mistrial with a jury split 11 for acquital and one for manslaughter. A newtrial for Kidwell has been scheduled.
The question to Konick on his involvement after the shooting came from Bob Evans, reportedly a friend and former employee of Saltonstall's who lives near Slate Mills. Evans passed two envelopes, each containing a list of typewriten questions, to Lee Bird, requesting the moderator to read the inquiries.
“These relate to the shotgun killing of Ranee Spellman,” said Bird, after scanning one list. “There are a number of questions here. The first one, ‘Isn’t it a fact that a police report states no fingerprints were found on the murder weapon Diane Kidwell testified she used to kill Ranee Spellman?' ”
A chorus of “Inappropriate!”, “Inappropriate!” came from several men in the audience.
“What I’m trying to ascertain is that it’s said Konick wiped the fingerprints off the murder weapon. That’s destruction of evidence. I don’t think it’s appropriate for a man like that to a running for commonwealth’s attorney,” said Evans. “Do you have any reply?” he asked Konick.
Moderator Bird interjected that the questions presented by Evans constituted an investigation rather than inquiries suitable for a candidates’ forum. “It’s up to the Bar Association or a judge to look into charges of misconduct (on the part of a lawyer),” he said, but added that Konick was free to answer the question in general terms if he wished to do so.
