Lawyers for The Inn at Little Washington have filed a petition for a writ of certiorari. The petition seeks a circuit court review of the conditions placed on the variance granted The Inn at th4 November 18 Town Cbuncil meeting. The Inn *U«sPeip* copies of “each anti every paper” in town files regarding the application, including minutes from all meetings held on the application.
The council had said that before additional work could be done on the building, the planters and part of the fence in front of The Inn must be removed and the two parking spaces that would be cleared at either ?nd would need to be paved.
Petitioning for The Inn’s jwners, lawyer David Dickey called the restrictions "illegal, void, arbitrary md capricious.”
Dickey said the conditions were illegal under the town’s zoning ordinance which only allows conditions >n improvements to be built uid not “ancillary conditions o other portions of the con•erned property”, according o the petition. At the same ime, Dickey said he was not ■onceding that the town’s trdinance was valid “which 'our petitioners expressly leny, but are aware that hey cannot raise such issue n this action.”
