parking problems near The Inn, a finding which he argues is contrary to the special use permit issued on October 12 “which special use permit found as fact that The Inn at Little Washington was already providing adequate parking and merely required The Inn to ‘continue’ to provide adequate packing.„
In addition, fche petition alleges that the restrictions are “arbitrary and capricious” because The Inn would by its own estimate bear an economic loss of approximately $32,500 in complying, a sum which Dickey says “bears no rational relationship to the health, safety and well being of the town of Washington.”
Dickey added that The Inn had offered to return to the Town Council if parking should become a problem i,n the future. Finally, he charged the restrictions with being discriminatory enforcement of the town’s “purported” zoning ordinance.
The petition was filed just days after Dickey had withdrawn a petition for a writ of mandamus, asking the court to review zoning administrator David Konick’s refusal to issue a building permit. The petition became moot when Rollick issued the permit on December 13 based on revised plans. These plans had eliminated portions of the project which The Inn still wants to build, but which require the variance.
