More than ninety days having elapsed since the death of the said Frank T. Thomas, such payment and distribution will be subject to the following conditions: (1) receipt of due proof of the appointment and qualification of the personal representative of the estate of Frank T Thomas in California: (2) publication of this notice once a week for four successive weeks in the Rappahannock News, a newspaper of general circulation in Rappahannock County, Virginia, where the Transferor resides; (3) the lapse of thirty days from the completion of such publication: (4) that at the time of payment and distribution the Transferor has no actual notice of the appointment of a personal representative of the estate of said Frank T. Thomas, deceased, within the Commonwealth of Virginia; and (5) subject to determination of the Circuit Court of Arlington County, Virginia, of the entitlement of Frank T. Thomas to receive such residue.
