WHAT IS A FIXTURE?
All of our agents sooner or later become involved in a dispute between a home buyer and seller about what fixtures are included in the home sale. Problems regarding the inclusion or exclusion of these items from the home sale can be solved in two ways. One is to understand what a fixture is. The easier method is to specify in the written sales contract which fixtures are included in the sales price.
A fixture is personal property which is permanently attached to real property. An example is a bathroom sink, which becomes a fixture when it is bolted to the wall. A sale of real property includes any fixtures, unless they are explicitly excluded.
As our staff can testify, it’s not always easy to tell what is a fixture and what is personal property. Rather than going to court or losing a sale, it’s best to provide in the purchase and sale contract for disposition of troublesome items such as window coverings, appliances, carpets, outdoor plants, chandeliers, mirrors and TV antennas.
