Regarding Mr. Aurich’s application, “In essence what we’re doing is clustering,” said Wakefield representative Werner Krebser. “Does the deed on the remaining parcel show that the density allowed has changed? If it is not recorded on the deed I don’t think we have control.”
Dr. Krebser suggested that the 180 acre parcel would have allowed seven lots of 25 acres or more, but now only six would be allowed on the 170 to 175 acres remaining.
“It would be hard to write,” County Administrator John McCarthy commented. He noted that the zoning ordinance might be changed in the future allowing for more density. The planners had not made such a requirement in a similar case last month, Mr. McCarthy commented.
“I think we were wrong by not requiring that it be recorded in the deed that the remaining parcels be less,” Dr. Krebser said. “All we did was tell the man that he understood that.”
