He told the council that when the L.O.M.P. partners: Dean Morehouse and his wife Linda, Susan and Robert Parrish, Patrick O’Connell and Reinhardt Lynch, realized the error they asked for a survey, to determine whether the lots could be included in the boundary adjustment procedure then open by the town and county. However, Mr. Reynolds told the council, because more than half of lot #5 lies outside the town boundary, it did not meet one of the criteria to apply for the adjustment: that at least half the lot be already inside the town boundary.

Mr. Reynolds said that the L.O.M.P. partners may benefit from a general boundary adjustment for all so-called “straddle lots,” but the attorney told the council “I recommend vacation regardless of the outcome of the boundary adjustment process.”

Asked how the oversight could have happened, Mr. McCarthy theorized that because the town/county boundary was not shown on the subdivision plats submitted to the council, “it appears to me that the council was not aware that part of the Stuart property was outside the town boundary.”
