Mr. Luke noted that Jeremy Clem had not mentioned in the statement anything about stopping and dropping off any trash at the dumpster.

A recess was called after all of the commonwealth’s evidence was presented, and the jury was sent out of the courtroom. Mr. Gulick made a motion to strike the commonwealth’s evidence in the case, i Mr. Luke said, “I think the commonwealth has carried its burden of evidence in this case. There is only one person who could have committed this offense, and that is Mr. Hamrick.”

Judge Robertson allowed the ( case to continue.

When the jury returned to the courtroom, Mr. Gulick called Jeff Clem, brother of Jeremy Adam Clem, to the stand.

Jeff Clem testified that he was with his brother and Mr. Hamrick at a party until 11 p.m. or 11:30 p.m. on the night of July 27, and that Mr. Hamrick was wearing tan shorts, no hat and no shirt.
