Mr. Clem, Jeremy Clem’s father, testified that Shawn Hamrick sometimes stays at the Clem house, and had kept clothes at their house before. He said that Mr. Hamrick had on tan shorts and no shirt on the night of July 27.
Mrs. Clem, Mr. Clem’s mother, testified that Mr. Hamrick was wearing a shirt and khaki shorts, and no hat that night.
Mr. Gulick next called his client, Shawn Alan Hamrick, to the stand.
Mr. Hamrick testified that he attended a party with Jeremy Adam Clem on the night of July 27, 1993, and that they were in Mr. Clem’s father’s truck. “We just went riding around,” he said. He claimed that he and Mr. Clem had put trash in the back of the truck from the party, and had driven to Flint Hill. They stopped at Foster’s Packing House and got a drink. They then drove north on U.S. 522, then turned around so they could take the trash to the dumpster.
Mr. Hamrick said he told Mr. Clem to let him off at the dumpster so he could “use the bathroom.” He said Mr. Clem then drove off, turned around, and was headed north on U.S. 522 when he picked up Mr. Hamrick at the dumpster.
They then proceeded north on U.S. 522 and noticed a truck come up behind them Mr. Hamrick said. Tliey kept driving, turned right on Route 635, and went home, he said.
Mr. Gulick asked Mr. Hamrick if he had anything to do with the hay bales on fire that night, and replied, “No”. '
