ARB Chairman Donna Kevis replied, “I think the ARB has the right to review this because of size and position in the town. It would be a significant enough change in the center of town.”
Mr. Gooch continued, “My question is whether there is jurisdiction; whether it can be considered. It is a matter of law. If you do not have jurisdiction, then opinion is not the deciding fartor. The ARB needs to decide if this is a building, fence, structure, parking lot or sign. If you say it is a structure, then you have to live with the definition of structure that is in the ordinance.”
