Judge Robertson sentenced Mr. Phelps to five years and the cost of the prosecution. Mr. Phelps will be evaluated for a treatment program for alcohol abuse, though it is up to Higera House if they accept Mr. Phelps into their program. Judge Robertson told him, “You have many good attributes but alcohol has been your undoing. This court does have an obligation to protect society. This will be your last shot. You have one of the most difficult drinking problems I have seen in this courtroom. I do not want you to be a hazard to yourself and other people.”
/ Commonwealth Attorney Peter Luke withdrew from his plea agreement with James Franklin Butler, 33, of Culpeper, and asked the court to set the matter for trial.
Mr. Butler had been previously charged with receiving stolen property belonging to David and Helen Smith. The plea agreement which he had entered into with the Commonwealth reduced the original felony charge to a misdemeanor.
