Dean Hahn if he knew of a center in the state which had a longer program. Mr. Hahn said, “There is a 12 to 18 month intensive program at Higera House in Roanoke. It is very structured and clients have to do chores around the house. They have to attend nightly meetings. ”

Mr. Reynolds said, “I have never seen such a situation where you can so strongly point to substance abuse as a contributing factor. The way I see it is we are the only chance he’s got. He has said many times that he can handle it, and he cannot. I would ask the court that he not be sent back to jail. I think the only thing we can do for Gary Phelps and society is to find him a program.”

Judge W. Shore Robertson said, “Higera House is extremely rigorous and we had a woman drop out of there after one weekend. ”

Commonwealth Attorney Peter Luke said, “When you operate a motor vehicle when drunk, we cannot look only to what is in the best interest of the defendant in this case. He presents a deadly threat to anyone else on the highway. I feel he should receive the maximum of five years, but I am all for him going through this program.”
