Judge William Stephens told Ms. Critzer, “Ignorance of the law is no excuse. I have no options but to find that you violated the terms of the section. I impose a civil penalty of $50. If you disagree you can appeal the case.”
Ms. Updike was represented by attorney J.W. “Bill” Fletcher. He told the judge that he had never seen a statute that was both civil and criminal. Judge Stevens told him his client was charged with a civil penalty but that it was a criminal proceeding.
M^jor Streapy testified that Ms. Updike told him that she did not know it was a violation. He also said that there were other papers in with the sample ballot. Mr. Fletcher then wondered if the ballot was then legal since it was with campaign information from Ms. Updike. He also argued that the summons issued to Ms. Updike was not on the proper form.
