Mr. Fletcher told the judge, “You cannot prosecute someone civilly on a criminal matter.” He made a motion to strike the Commonwealth’s evidence in the case, and Judge Stephens denied it.
Ms. Updike took the witness stand next. She testified that Doris Critzer offered to take her resume and the ballot around town when she gave out hers, since Ms. Updike was working. She told Mr. Luke that she had made up the ballot the week before April 18, when it was handed out.
Mr. Luke said, “The Code is clear. ‘Authorized by1 must go on the document itself. The Commonwealth asks for a $50 civil penalty.”
Judge Stephens imposed a $50 civil penalty on Ms. Updike.
