“The older man began shouting .ve were not going to take his guns ind he kept advancing towards me in t threatening manner." Mr. Dwyer said from the witness chair. "It was a ,ery tense situation. I had the gun in ny hand. . . . After I said I was scared ind an old man and didn't want to lurt anyone, then he turned away.” he ldded.
At that point Mr. Blosser went iack to the two shotguns that were on he gound some distance away. put hem on his ATV, went back to his touse and called the Sheriffs Office ind then headed back to the old packng shed, where he, the two hunters ind Mr. Dwyer met Deputy Connie Compton about 3 p.m.
At her request Mr. Blosser put the :wo shotguns into her car. When the elder Mr. Sims and Mr. Dwyer continued their argument. Deputy Compton asked Mr. Dwyer to sit in her car. "They wanted to go at each other’s throats, no doubt about that,” she told the court.
Mr. Dwy er told the court that he has posted signs at his driveway entrance and at several other places on his property . He explained to the judge that he has lived there for 35 years and owns 800-900 acres. “The property line is seven to eight miles long; 1 can't afford to hang a posted sign on every tree." he said.
However, no testimony was presented that any posted signs were visible along the fence line the hunters crossed when they strayed onto Mr. Dwyer's land
As a result Judge Tolley ruled they could not be found guilty of trespass under section 18.2-134 of the Code of Virginia. If they had been charged under 18.2-132. they would have been guilty, but that section describes a lesser offense, he said.
