After a preliminary hearing in General District Court on Tuesday, the court decided that a malicious wounding charge against Roy Wayne Sisk, 31, of Sperryville, will go to the Grand Jury on May 8.
The Grand Jury will then decide if Mr. Sisk should be indicted for the felony, and if so, the case would then be heard in Circuit Court.
Mr. Sisk was charged with malicious wounding after an incident at the 211 Quicke Mart that took place around 1 a.m. on December 31, 1994. According to witnesses at the preliminary hearing, he allegedly struck Ernie Fletcher twice, at least once with brass knuckles in the back of the head; the blows knocked Mr. Fletcher to the ground.
Mr. Fletcher died of unknown causes in March. An autopsy was performed on him in Washington, D.C., but the results have not yet been received.
Michael Joseph Starks, who was with Mr. Fletcher that night, testified at the hearing that he and Mr. Fletcher had gone to the 211 Quicke Mart for some food. Inside the store, he said
