In finding Mr. LeVans guilty, Judge Foley said, “Sometimes people need to have the roof fall in and force them to crawl through the gutter to get out before they decide they do not want to be there any more.”
“I won’t go into why, but I am very familiar with the disease of alcoholism,” he added.
The judge then fined Mr. LeVans $500, with $200 suspended, and sentenced him to 12 months in jail, with eight days to serve, on weekends. He also suspended Mr. LeVans’ license for three years, although he will be eligible for a restricted license through VASAP after four months.
The judge also ordered Mr. LeVans to continue his counseling program and any aftercare program that may be suggested to him.
