Mr. Fletcher at the Fauquier Hospital emergency room, testified that he treated him for a scalp laceration on the back of the head which required three or four stitches, and that X-rays showed that he also had a fractured scapula and rib. He also said that Mr. Fletcher was alert and had not lost consciousness.
After hearing all the testimony, Commonwealth’s Attorney Peter Luke said that a dangerous weapon had been used with malice inferred, and asked that the case be given to the Grand Jury.
Judge Charles Foley agreed, and set the case to be certified to the Grand Jury on May 8 at 10 a.m.
Mr. Sisk is free on bond, but was cautioned by Mr. Luke to have no contact with any witnesses or the family of Ernie Fletcher. Judge Foley also told him that the Commonwealth may have additional charges against him, pending the results of the autopsy.
The charge of malicious wounding against Oscar Ray Sisk, 33, of Washington, was dropped. He was with Roy Wayne Sisk the night in question, but witnesses said.that he was not involved in the assault.
