In Rappahannock County Circuit Court last Thursday, George D. Coldsmith, 25, of Chambersburg, Pa. was sentenced to five years in the Dept, of Corrections on a charge of cocaine posses- : ' sion and 30 days in the jail, for a marijuana possession charge.
Both sentences were suspended and Mr. Coldsmith * will spend two years on supervised probation. 3
Mr. Coldsmith originally pleaded guilty to the charges last August but adjudication was suspended i because he is a first offender. One of the conditions of being on first offender status was to remain drugfree! Mr. Coldsmith tested positive for cocaine use twice last October and failed to keep some appoint- ^ ments with the court services program, so he was brought back into court to face Judge W. Shore Robertson.
Commonwealth’s Attorney Peter Luke said that Mr. Coldsmith had returned to drug use after attend- ^ ing a substance abuse program, and believed he f needed more in the way of drug treatment.
Judge Robertson told Mr. Coldsmith may transfer his probation to Pennsylvania and must participate in a substance abuse program. “If you come back here in violation you could be required to serve this sentence," said Judge Robertson.
In General District Court on Tuesday, Arthur H. Kitchen of Amissville was fined $1000, with $800 suspended by Judge Charles Foley, for dumping violations he was found guilty of earlier this year.
Judge Foley also sentenced him to a total of 12 months in jail for the three violations, and suspended that time.
