In execution a Deed of Trust in the original principal sum of $135,000.00 dated the 8th day of January, 1993, recorded in Rappahannock, Virginia, in Deed Book 195, page 655, the undersigned Trustee will offer for sale at public auction on Friday, May 23,1997 at 1:00 p.m. local Time at the front steps of the Circuit Court House, Rappahannock County, Virginia, the following: all that certain tract or parcel of land situate, lying and being in Piedmont Magisterial District, Rappahannock County, Virginia, containing 5.675 acres, the metes and bounds of which are more accurately described in the deed of trust recorded in Deed Book 195, page 655. The street address of the property is 9 Josh Ben Lane, Sperryville, Virginia 22740. The property is improved by a residence and other valuable improvements.
THE PROPERTY AND IMPROVEMENTS ARE SOLD AND WILL BE CONVEYED "AS IS", WITHOUT WARRANTY, EXPRESS OR IMPLIED, EXCEPTING ONLY THE TRUSTEE’S SPECIAL WARRANTY DEED.
The sale of this property is subject to any easements, restrictions and matters which may be of record including any unfiled or unrecorded mechanic’s liens, all liens which may affect the property, and the rights, if any, of any parties in possession. Obtaining possession of the property shall be the responsibility of the purchaser.
TERMS OF SALE: Cash with a successful bidder's deposit of 10% of the sales price by certified check, or such other funds as may be acceptable to the trustee at time of sale and balance upon tender of Special Warranty Deed, settlement to be held on or before June 5,1997, at 10:00 a.m., time being of the essence, in the Circuit Court Clerk's office of Rappahannock County, Virginia. The Trustee reserves the right: (i) to waive the deposit requirement; (ii) to approve the creditworthiness of any bidder; (iii) to withdraw the property from sale at any time prior to the termination of the bidding; (iv) to keep the bidding open for any length of time, not to exceed 20 days; (v) to postpone the sale one or more times as he may deem advisable; and (vi) to require a bidders deposit by certified check of at least 10% of the sales price before any bid is received. In the event the purchaser should fail to complete his purchase as set forth above, the deposit shall be retained by the Trustee and applied to the costs and expenses of the sale and the balance, if any, to be retained by the Trustee as compensation for said sale. Examination ol title, conveyancing, and recording fees shall be at the expense of the purchaser.
