In closing arguments, Konick maintained that Wallace’s offense was not severe enough to merit a reckless driving conviction and that he was guilty only of improper driving for failing to keep his vehicle in the road.
Commonwealth’s Attorney Peter Luke said driving on the wrong side of the road and causing an accident was indeed severe enough to merit a conviction. Alexander agreed, found Wallace guilty, and ordered him to pay $600 and costs.
