While maintaining that the regulations “on the books” governing landfills are “exactly the same” today as they were in 1977 when the Clark dump was established, he conceded that the county’s current trash depository has neither a trench liner nor a leachate collection system. Both are now required for new landfills, but as a policy matter rather than by regulation, Mr. Gregori explained.
He also noted that permit submission criteria enacted since 1977 now set the tests which must be performed on proposed landfill sites. In addition, privately owned and operated landfills must now meet financial assurance requirements.
