The amendment adopted at Monday’s board meeting was initially advertised for public hearing by the Planning Commission in June and the Board of Supervisors in July. Tacked on to the end of a list of technical “housekeeping” changes to the newly approved zoning ordinance, it drew no public comment at the commission’s hearing. Neither did the commissioners mention the implication of the change, which reads simply that “the county of Rap-pahannock shall be exempted from the terms hereby with respect to any activity, structure or project undertaken by it which is required by law.”
But publicity as to its practical application brought opposition from Amissville to the Board of Supervisors’ hearing. Representatives from the Jackson District Citizens Committee asked for an opinion from Peter Luke, Commonwealth’s Attorney who also serves as county attorney and legal advisor to the board. Deferring to that request, the board postponed action until August’s meeting.
