Member Newbill Miller asked! what happens to non-conforming! uses that are grandfathered in when the non-conforming use is discontinued. Town attorney Frank Rey-1 nolds Jr. said that any nonconforming use that exists before the ordinance was passed can be continued, but after “two years of dis-; continuance (the property) returns to the ordinance.”
Mr. Reynolds said that to qual-: ifiy for a hardship exemption, the “hardship must be more than an inconvenience,” and must meet the state definition.
The Council voted favorably toT; approve the amendments, and then voted favorably again to approve and adopt the entire ordinance. Both votes were unanimous, making the Zoning Ordinance effective Sept. 9, 1993.
The Council approved a request from the Ki Theatre to hold a Street Fair on Gay Street, Saturday, Oct! 9, as long as the street is not blocked off from traffic. The festival will be a part of Ki Theatre’s Crossroads 1993 celebration. !*.
The fire department will be the, recipient of a $3,000 grant receive^ by the town, reported treasurer Brad Fisher. The grant, from the Virginia Fire Services Board, can be used for fire department education and courses or equipment. The Council suggested that the money be used to place a dry hydrant at Carrigan’sPond.
Mr. Steve Critzer was elected ta fill the vacancy on the Planning Commission resulting from the resignation of Arthur Neufeld. Mr.. Critzer also presented a report to the Council from the Architectural Review Board. The ARB asked the Rappahannock News to clarify that the role of the ARB in architectural matters is to “judge appropriated ness, not safety.” Mayor Morehouse requested that minutes of all ARB, meetings be entered in the town record.
No complaints have been received about the barriers at the intersection of Main and Middle streets squaring off the southeast corner. The council will request that the Department of Transportation complete construction of curbing and sidewalk at the corner.
The Council commended Louise Van Dort for her continued volunteer help moving records and sup? plies to the new town hall. J
Several members of both the Council and the audience said they had problems hearing and under-! standing each other because of the( poor acoustics in the town hall. Mayor Morehouse they plan to put down a carpet, yrhich should improve the situation.
