Terms: Sale shall be to the highest bidder for cash who is a qualified purchaser, and the successful bidder shall provide to the Special Commissioner of Sale at least ten percent (10%) of the final bid amount by cashier’s check or certified fund prior to the property being cried off to the successful bidder, said funds to be payable to the Marshall National Bank and Trust Co. as General Receiver for the Circuit Court of Fauquier County, Virginia; sale to be confirmed by the Court, at the proper time, the Court will direct the successful bidder to deposit the entire balance of purchase price in Marshall National Bank and Trust Co. as General Receiver for the Circuit Court of Fauquier County, Virginia to the credit of the Court of this cause; in the event purchaser defaults, the property shall be resold at the expense and risk of the defaulting purchaser, the Court dispensed with the giving of bond by the Special Commissioner; the property is to be sold by the Court free from all liens ex'cept for 1999 real estate taxes which shall be prorated to the date of settlement.
