As late as the hearing date, the applicant still had not responded to the state officer’s request for the listing of historic properties, a critical first step in the conduct of any historic review. Our conclusion was that we did not know with certainty if any of the locations had Em adverse effect on any historic property. Our position on the applications was specifically limited to the failure of the applicant to bring in completed applications for consideration, for lack of the historic reviews.
We appreciate the fact that an application could be approved even if an historic review concludes that one or more historic properties would be adversely affected by the antenna location. However, as stated at the hearing: “If we are to be true to our mission to preserve our Rappahannock heritage, as well as to our status as a consulting party under the National Historic Preservation Act, the Rappahannock Historical Society must insist that the historic review of the applications for these antenna locations be in keeping with the language and intent of the law.
