The commonwealth’s attorney’s office’s decision to “nol pros” the case means the charges against Harris could be pursued if new evidence surfaces against him
Nol pros is short for nolle prosequi - Latin for “we shall no longer prosecute” - and is a formal entry by a prosecutor in a criminal case that means he will not pursue the matter further.
On Monday, Shaia said fingerprints found at the robbery scene are still being analyzed and the final decision on the charges against Harris will not come until those results are in.
Due to a backlog at the state laboratory, Shaia said he does not know when the forensic examination will be complete. Rather than let the case drag on, the commonwealth’s attorney’s office decided to grant nol pros, he said.
“If it Comes back favorable, then [Harris] doesn't have anything to worry about,” Shaia said.
At that point, Shaia said, Howard will be able to file an expungement to have the arrest erased from Harris’s record.
