Other witness testimony revealed that Cloniger had suggested burning the body to destroy the evidence. “Is this the act of a someone who has said that this is a justifiable homicide, or is this the act of someone who is guilty?” Luke said in his final statement. Pierce testified that Cloniger fled on foot as soon as he saw a sheriff’s office cruiser.

Rappahannock County Sheriff’s Office Deputy Ibny Leake, the first deputy to respond to the scene, said that Pierce was “hysterical,” when he arrived. “When I was talking to Miss Pierce she stated that Eddie had raped her, and Wayne had passed out in the truck and that “Wayne had walked in on them,’” Leake testified.
Rappahannock deputies also testified about Cloniger’s behavior during his time in custody. Testimony by chief investigator Lt. Connie Smith revealed that Cloniger had boasted about evading capture. According to Smith,
