wants to put pool tables, video games and pinball machines in his former garage building. He acknowledged that he doesn’t have a septic permit yet and proposed to rent an outdoor sanitary “john” to serve the game room.

According to Payne, there’s adquate parking space in front of the garage although he plans to continue operating the fruit and vegetable stand currently on the same site. The two businesses won't compete for parking area, he said, adding that the fruit stand will be open during the day while the game room will be “primarily a night operation but if business picks up, I will open it during the day.”

Payne said he plans only to sell soft drinks and hot sandwiches from a machine with no alcoholic beverages even allowed on the premises.

Konick reported that Payne’s lot is one of several in the vicinity circled by the ambiguous green line.

“Frankly, gentlemen, I just think it was a mistake (that Payne’s garage wasn’t designated commercial when the official zoning map was colored)," said the zoning administrator.

He noted that a nearby lot with nothing built on it is marked as commercial although the property “is not commercial in any way.”

According to Konick, commonwealth’s attorney Douglas Baumgardner has ruled that the zoning map is part of the county’s zoning law. "Even if it’s a mistake.
