While acknowledging the sincerity of Jenkins' conversion to Christianity, commonwealth’s attorney Douglas Baumgardner stressed the seriousness of the charges against the defendant. He noted that Jenkins put four bullet holes into an occupied pick-up truck. "One even pierced a tool box and struck the back of the truck "where a woman passenger was sitting, Baumgardner said. "She came very close to losing her life.”
The defendant’s religious conversion "cannot and should not alter the court’s disposition of this case,” he argued, citing the "mind boggling precedence” such action would create.
Baumgardner argued that Jenkins should be incarcerated and if part of his sentence is suspended and he is imprisoned in jail rather than the penitentiary as the probation officer recommended, his probation should be conditional upon continuance of alcohol counseling.
