In closing arguments, Baumgardner emphasized that the cousin Peggy Bailey was ‘‘very conveniently deceased,” and that it was “A bit too convenient that he (Coates) would go out and get one (check) that was forged from someone who is now dead.” Baumgardner also pointed out that Coates had broken his promise to Bailey by buying things for himself with her money, ‘‘You (Coates) strike a bargain with your cousin, then YOU go out and spend the money."
Elliott DeJarnette closed with the argument that Dusek could only say that Coates was probably, but not positively, the author. DeJarnette also questioned the validity of Hackley’s
