Nine Months Revocation
On an appeal from a General District Court conviction of driving under the influence, Lonnie Gene Clatterbuck of Sperryville entered a guilty plea.
Baumgardner noted that Clatterbuck had also been convicted of resisting arrest after he used abusive language and struggled with deputy Mark Wittl as he was apprehended. As a result of the aggravated offenses, Baumgardner argued that the one year license suspension plus fine given Clatterbuck in General District Court should be sustained.
Attorney Bill Fletcher countered that his client hadn’t been involved in an accident and needs an operator’s license to continue his job with the Virginia Department of Highways. He asked for a one year license loss' with six months suspended on condition that Clatterbuck participate in alcohol counseling.
