Requesting probation for his client, Albrecht emphasized that Jenkins’ offense was potentiality serious but the potentiality was “fortunately not realized” since none of the three passengers iti the vehicle were injured in the shooting. He maintained that Jenkins has made a dramatic adjustment since September 26, 1981. “It’s not a ‘flash-in-the-pan’ change in attitude.” he added.
“I’m pleased to hear from you and your pastor that your life has altered substantially. I believe your feelings are genuine. . . But under the laws of this state, you must be held accountable for your past offenses,” said Judge Robertson, sentencing Jenkins to three years in the penitentiary- He suspended all but six months of that time, however, and placed the defendant on supervised probation for three years, requiring that he make restitution for damages to the pick-up truck, pay court costs and continue in an alcohol counseling program under the direction of his probation officer.
Robertson added that he will entertain a motion that lenkins be put on a work release program if a job can be found, an option which will allow the Washington man to serve his time in a local jail.
At the close of the sentencing hearing, sheriff Buntin contacted Fauquier ail and secured permission to incarcerate the prisoner in the Warrenton facility'.
