However, there is some ambiguity as to when that time period started—July 8, the day Home was served with the writs, or July 15, the point at which the writs were filed with the Supreme Court in Richmond. ‘These procedures are not common so I’m taking the safe position—that they have 14 days from July 15,” Luke said.
He added that the attorney general can designate Kidwell’s counsel attorneys, the orginators of the closure motions, to represent Judge Home.
“Generally, if no answer is filed, everything (in the writs for prohibition and mandamus) is taKen as admitted. If that happens, I think the court will grant the relief we’ve requested,” Luke said.
