The Rappahannock County Board of Zoning Appeals on November 28 upheld a decision by Zoning Administrator David Konick to revoke a building permit issued to Patricia Saltonrtall of Points of View Farm in Flint Hill.
Konick revoked the budding permit for Lot G of the Lindgren “Whaley Tract” located off Route 729 because of an earlier BZA ruling on September 26 that a similar house already built on Lot F of the same tract is in violation of the zoning ordinance. The-BZA found that the house on Lot F is built ifc^ duplex style and is built in a conservation district where multi-family dwellings are prohibited. Saltonstall is appealing that decision to the Circuit Court.
Doug Baumgardner, legal counsel for Saltonstall, told the Board that the building permit appeal would be based on arguments presented during the discussions of the house on Lot F, and not on procedural questions or on whether or not the Board agreed with Konick’s decision.
“You want us to, in essence, reconsider that decision (of September 26), and I don’t think that it’s necessary for us to do that,” said BZA member Peter Kramer. “If you want to appeal then you should appeal his (Konick’s) procedure or appeal on the basis that you think he was wrong and present arguments as to why you think that.”
