The procedural question involves whether the zoning administrator or the building inspector should revoke building permits. Konick told the Board that he revoked the permit because the building inspector was on vacation and he thought that Saltonstall should be advised of the decision before building on Lot G began.
Board member Gregory Monahan made a motion to uphold Konick’s decision to revoke the permit because his decision was based on the BZA’s ruling on September 26, and because Saltonstall did not have a special use permit to build a multi-family dwelling; in a conservation district. The motionpassed unanimously.
Also before the Board were two special use permit applications from Saltonstall which again involved Lots F and G. The application for Lot F was for the maintenance of the house on the lot, and the application for Lot G was for the construction of the similar dwelling. In both applications, the Board was requested to determine whether the lots are in an agricultural or conservation district.
Baumgardner told the Board that its ruling placing the house on Lot F in violation of the zoning ordianance was accepted, but not agreed to, only to present the applications, and that the house is being used as a single family dwelling. The Board denied a special use permit for the house on Lot F in October of 1983.
