Brown was arrested by Lt. Jenkins on that charge on June 2 and released on his own recognizance later that day. He was free pending the June 17 hearing at the time of the slaying of Mr. Timmons.
When asked about the delay in indicting Brown in connection with the shooting, Commonwealth's Attorney Peter Luke explained that direct indictment by a grand jury “is less inconvenient for the witnesses, and it sav'-es time." Since Brown already was being held on other charges, the procedures of swearing warrants, arrest and preliminary hearing were unnecessary, he added.
All those steps are preliminary to a grand jury hearing, so the direct indictment approach was more sensible in this case, he said. Last Friday was the first date available to convene a grand jury in Rappahannock.
