A malpractice suit brought against a local attorney has been settled out of court.
According to records on file in the Rappahannock County Clerk’s office, Diane Kidwell’s $300,000 suit against David Konick has been “compromised and settled" under an order entered October 6, 1986. The terms of the settlement are not included in the case file; the file itself carries a notation, “cassette in locked cabinet.”
Contacted by telephone for comment, Mrs. Kidwell explained that both parties had signed a confidentiality agreement, barring them from discussing the settlement terms.
Mr. Konick represented Mrs. Kidwell and her husband Roger in a right-of-way dispute with adjoining landowner Patricia Saltonstall. In November 1982, Mrs. Kidwell shot Mrs. Saltonstall’s farm manager, Ranee Spellman, from a bulldozer on the contested right-of-way. Following a grand jury investigation, she was charged with murder. Her first trial ended in a hung jury, its members split with 11 for acquittal and one for a manslaughter conviction. In her second trial, Mrs. Kidwell was acquitted, the jurors finding that she acted in self-defense.
