The Board of Supervisors on Monday adopted two “housekeeping” amendments designed to bring Rappahannock’s subdivision regulations in line with state law.
Borrowing * language directly from enabling legislation, the first amendment gives the supervisors authority to grant an exception to provisions of the subdivision ordinance in “unusual situations” or when strict adherence would result in “substantial injustice or hardship.”
The board had that authority under the existing ordinance but conditions under which an exception could be granted were outlined with1 greater specificity and only certain regulations were eligible for exceptions. “The new language gives you more discretion to grant exceptions IF you want to,” noted Commonwealth’s Attorney Peter Luke, legal advisor to the board.
