Mr. McCarthy told the planners that, in his opinion, they could not make a finding on the question of sufficient access to the property, and he recommended that the permit be denied on that basis.

The commissioners agreed, voting four against, with Mr. Miller again abstaining. He cited a conflict of interest as the former landowner who subdivided the area and sold property to several of the individuals involved, including Mr. Young and Mr. Burke.

The spirit of the small community was evident after the hearing was closed, as the neighbors who spoke in opposition to Mr. Young’s request walked across the courtroom and exchanged handshakes with Mr. and Mrs. Young. Several stayed and talked for a few minutes, assuring the Youngs that there were no hard feelings over the permit.

A third application, for the vacating and resubdivision of the Eiten property outside Flint Hill, was approved unanimously.

It drew questions from Joyce Settle, who told the commissioners that she wanted assurances that the vacating of the plats would be recorded along with the resubdivision. She alleged that illegal subdividing had been done before, and wanted to be sure that the 80-acre parcel could not be resubdivided into “four or five more lots.”

’This will stand until the subdivision ordinance is changed or there is a change in the zoning ordinance,” Mr. McCarthy told her. “I would be interested to know what slipped by before.”

“A matter was done and can be proved in a court of law,” Mrs. Settle replied.

“Pray prove it and let me know,” Mr. McCarthy said.

“I want the subdivision ordinance adhered to strictly,” Mr.. Miller added.

“I appreciate that (Mrs. Settle) came in to make her point,” said Commissioner Werner Krebser.

With no further comments, the re-subdivision was approved 5-0.

The Planning Commission scheduled a work session on the proposed revisioirof the subdivision ordinance for Wednesday, Oct. 7, at 7:30 p.m. at the Courthouse.
