“If you want to challenge alleged irregularities,” Mr. Gooch replied, “then you are throwing good money after bad . . . the state would not accept the boundaries if the requirements of legal notice and hearings were not met.”
Mr. Smoot also challenged the town’s right to apply its ordinances a house built outside the town boundary.
That’s the tradeoff, Mr. Gooch told him. “If you use town land in order to get a building lot. because we give you that right in return you have to be subject to the town's Historic District Ordinance.”
After hearing that the Board of Supervisors had agreed “in princple” to the straddle lot solution at its meeting, the council also voiced its unanimous approval.
